Bylaw C14-03 - Alarm Systems

NOW THEREFORE, the Council of the City of Fort Saskatchewan, in the Province of Alberta, in open meeting of Council enacts as follows:


1.1 This bylaw is cited as the Alarm Systems Bylaw.


2.1 In this bylaw,

            a) “alarm system” means an electrical or mechanical device that detects an unauthorized entry to, or an emergency on
a premise;
            b) “city” means the City of Fort Saskatchewan; 

            c) “council” means the Council of the City of Fort Saskatchewan;

            d) “emergency” means an unexpected situation or sudden occurrence of a serious or urgent nature that demands immediate action;

            e) “false alarm” means the activation of an alarm system where there is no emergency on the premise;

            f) "offence" means an offence under this bylaw;

            g) "peace officer” means a peace officer as defined in the Provincial Offences Procedure Act, R.S.A. 2000, cP-34;

            h) “person” means an individual, sole proprietorship, corporations, partnership, joint venture, co-operative or society;

            i) “premise” means and includes any store, office, warehouse, factory, building, enclosure, yard, dwelling, or other place used, or capable of being used, for the purpose of business, pleasure, or permanent residential dwelling;

            j) "specified penalty" means an amount determined pursuant to this bylaw that can be paid by a person who is issued a violation ticket and is authorized to make a payment without a Court appearance;

            k) “violation ticket” means a violation ticket as defined in the Provincial Offences Procedure Act, R.S.A. 2000, cP-34;

            l) "voluntary payment" means payment pursuant to the Provincial    Offences Procedure Act, R.S.A. 2000, cP-34;



3.1 When a false alarm at a premise results in the attendance of a peace officer, the person responsible for the said premise shall be responsible for all fines as issued pursuant to this bylaw.


4.1 Any person who is in contravention of this bylaw is guilty of an offence and subject to receive a violation ticket as follows:
Offence Penalty

Peace Officer Response-False Alarm: first offence Warning

Peace Officer Response-False Alarm: second offence $200.00

Peace Officer Response-False Alarm: third offence $300.00

Peace Officer Response-False Alarm: fourth and subsequent offences $500.00
4.2 Any person, who commits an offence, may pay the specified penalty indicated on the violation ticket, in which case, the person will not be prosecuted, in court, for the offence.
4.3 Any person who violates any provision of this bylaw shall be liable, upon summary conviction, before a Magistrate, in the City of Fort Saskatchewan, to a penalty not exceeding One Thousand Dollars ($1,000.00) exclusive of costs, for breach thereof, or in case of non-payment of the fine and costs to imprisonment, for any period not exceeding thirty (30) days.
4.4 Each section of this bylaw shall be read and construed as being separate and severable from each other section. Furthermore, should any section or part of this bylaw be found to be improperly enacted for any reason, then such section or part shall be regarded as severable from the rest of the bylaw and the bylaw remaining after such severance shall be effective and enforceable.
4.5 Wherever the singular, plural, masculine, feminine or neuter is used throughout this bylaw the same shall be construed as meaning the singular, plural, masculine, feminine, neuter, body politic or body corporate where the fact or context so requires the provisions hereof.


5.1 Bylaw C14-03 shall come into force and have effect on July 15, 2003.
